1. Agreement to these Terms

These Terms of Use ("Terms") form an agreement between you and VMH Digital ("we", "us", "our"), the developer and publisher of the PhoneVault Android application (the "App") and of this website. By downloading, installing or using the App, you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, please uninstall and stop using the App.

Where you obtain the App through Google Play, your use is also subject to the Google Play Terms of Service.

2. Eligibility

You must be at least 13 years old — or older where your country requires a higher minimum age of digital consent — and legally capable of entering into this agreement. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement of a parent or guardian who accepts these Terms on your behalf.

3. Licence to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on Android devices you own or control, for your personal or business calling. This licence transfers no ownership to you.

When PhoneVault is your default phone app, emergency calls (such as 112 or 911) are placed through the Android system's telephony service, as with any dialer. However:

5. Your content and your responsibility

Everything you create in the App — notes, tasks, directory contacts, categories, message templates ("Your Content") — remains yours. We claim no ownership, and because it is stored only on your device we have no access to it and no ability to moderate, recover or inspect it.

You are responsible for what you record. Notes about calls and people may be personal data of others under laws such as the EU/UK GDPR; where you record information about business contacts, you are the controller of that information. Record no more than you need, and handle it lawfully. If your jurisdiction restricts storing information about individuals without their knowledge, those rules apply to what you write in PhoneVault the same way they would apply to a paper notebook.

You agree not to use the App to harass, stalk or record information about individuals unlawfully; not to use decline messages or any messaging feature to send spam or unlawful content; not to decompile, reverse engineer, copy, resell or redistribute the App or its assets except where law permits; and not to circumvent its licensing mechanisms or distribute modified builds.

8. Intellectual property

The App, its source code, design, icons, themes, documentation, and the "PhoneVault" name and logo are the property of VMH Digital, protected by copyright and other intellectual-property laws. All rights not expressly granted in section 3 are reserved. Third-party components remain the property of their owners under their own licences. "WhatsApp", "Google Play" and "Android" are trademarks of their respective owners; PhoneVault is not affiliated with or endorsed by them.

9. Not professional advice; analytics are informational

PhoneVault's analytics describe your own call log and are provided for your information only. Nothing the App produces constitutes legal, financial or business advice, and deal stages in the directory are an organisational aid, not a business guarantee.

10. Reminders and notifications

Follow-up alerts are scheduled locally by your device. Their delivery depends on your notification settings, battery optimisation and whether the device is on. Do not rely on the App as your only reminder for a critical deadline.

11. Disclaimer of warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy and non-infringement. In particular we do not warrant that the camera scanner will read every number correctly, that caller identification or the unknown-caller flag will always be accurate, that blocking will intercept every unwanted call, or that notifications will always be delivered. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you; nothing in these Terms limits non-excludable statutory consumer rights.

12. Limitation of liability

To the maximum extent permitted by law, VMH Digital and its developers shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for loss of data, profits, goodwill or business, arising out of or relating to the App — including missed or failed calls, missed reminders, misread numbers, data loss, or device failure. Where liability cannot lawfully be excluded, our total aggregate liability for all claims relating to the App shall not exceed the greater of (a) the amount you paid us for the App in the twelve months preceding the claim, or (b) USD 50. Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

13. Third-party services

Calls and SMS are carried by your mobile carrier under its own terms and charges. Actions you trigger toward WhatsApp, your email app or your calendar are handled by those apps under their own terms. We are not responsible for the availability, performance or policies of any third-party service or network.

14. Updates, changes and availability

We may release updates that add, change or remove features, and may discontinue the App. We may also revise these Terms; the "Last Updated" date above shows the current version, and material changes will be posted on this page and referenced in release notes. Continued use after a change means you accept it.

15. Termination

You may end this agreement at any time by uninstalling the App. We may terminate your licence if you materially breach these Terms. Sections 5, 6, 8, 11, 12 and 16 survive termination. Termination does not delete Your Content from your device — that stays under your control.

16. Governing law, severability and entire agreement

These Terms are governed by the laws applicable at VMH Digital's place of business, without regard to conflict-of-law rules, and the competent courts of that jurisdiction have jurisdiction over disputes — except where mandatory consumer-protection law lets you rely on the law and courts of your country of residence. If any provision is held unenforceable, the rest continue in force. Our failure to enforce a provision is not a waiver. These Terms, with the Privacy Policy, are the entire agreement between us regarding the App.
